Z.Q. v. NYC DOE Lawsuit Information

Dear Parents and Guardians,

This week many, but not all, students are being provided with envelopes regarding the recent class action lawsuit, Z.Q. v. NYC DOE. A class action lawsuit is a legal proceeding where a group of people, called a class, is represented by one or more plaintiffs. This lawsuit was initiated by guardians with students in New York City Public Schools who may have not been provided with their required IEP services during remote learning from March 2020 through July 2021 stemming from the coronavirus pandemic. This is not an Aviation High School specific lawsuit, and the services your child may have received or been entitled to could relate to their elementary or middle school years. Therefore, if you receive an enveloped letter relating to this lawsuit, please review the following information carefully.

Your child is already considered to be a part of this class action lawsuit, and you do not need to do anything to remain a part of this lawsuit. Please note that to be a part of this legal proceeding the NYCPS may need to share documents that include information about your child, such as requests for services or make-up support. You can object to being a part of this lawsuit in order to withdraw your child’s name from this legal proceeding, if so desired.

If You Would Like to Object to Being a Part of This Class Action Lawsuit:

Complete the form at schools.nyc.gov/learning/special-education/help/zqferpa and submit it via:

If no objection is received by December 27, 2024, records may be shared.

This information is being shared with all parents and guardians, but only specific students who had IEP services between the dates listed above will receive more information regarding this class action lawsuit. If this pertains to your child, you will be receiving a backpacked letter with forms and further details. Our school has no further information than the information contained in this letter at this time.

If you have additional questions about this class action lawsuit, contact Advocates for Children at 212-225-9339 or visit advocatesforchildren.org.

Sincerely,

Steven R. Jackson

Student Classes are Available Online

Students can access their classes via TeachHub

Parents/Guardians can access their child’s classes via NYCSA (https://www.schoolsaccount.nyc/)

What if I can’t get into either account?  Your child will receive a paper copy of their schedule, along with their OMNY Card, when they come to school on Wednesday, September 4 according to the schedule below.

Why aren’t the teachers and room numbers showing?  That information is still subject to change.  It will be present on the paper copy that your child will receive on September 4.

What should I be looking for?  You should look to see that your child is not scheduled for a class that they have already passed or for a class not appropriate for their grade level. For example, a tenth year student scheduled for twelfth grade English. Or an incoming student scheduled for a class they have taken in the 8th grade.

What if I see a problem? Complete this form to let us know so we can work on making the change.  Please do not expect the change to be made before you receive the paper schedule.  It will take us a few days to process all program changes.

What if my child cannot remember their TeachHub password?  Parents/guardians can change their child’s TeachHub password in their NYCSA account. https://www.schoolsaccount.nyc/

What if I can’t remember my parent password? There is a “Forgot Your Password?” link on the NYCSA sign in page. https://www.schoolsaccount.nyc/

What if I do not have a NYCSA account?  You will have to contact our Parent Coordinator, Ms. Cordero, to set up your account.  Please be patient as this is the busiest time of year.
